DISCLOSURE STATEMENT FOR NZSKI LTD INSTALMENT PLAN.
IMPORTANT - The creditor is required to provide you with this disclosure statement under section 17 of the Credit Contracts and Consumer Finance Act 2003. This document sets out the key information about your consumer credit contract. You should read it thoroughly.
If you do not understand anything in this document, you should seek independent advice.
You should keep this disclosure statement and a copy of your consumer credit contract in a safe place.
This disclosure statement must be provided to you within 5 working days of the day on which the contract is made.
The law gives you a limited right to cancel the consumer credit contract. See the statement of the right to cancel below and your consumer credit contract for full details of your right to cancel. Note that strict time limits apply.

Initial unpaid balance:
This is the amount you will owe when you request to pay for your selected product from NZSki Ltd using the Instalment Option Plan. The initial unpaid balance is the figure reflecting the total amount payable as disclosed during the transaction process.
If the initial payment is not paid you are NOT eligible for the Instalment Option Plan. The Initial Unpaid balance is also referred to as the Instalment Balance due.
At any stage of the payment plan, the customer has the ability to pay the total outstanding balance due (including full prepayment).
Please note that a credit card surcharge of 1.2% may apply to your instalment payments. A credit card surcharge of 1.75% may apply to payments that do not use the NZSki Instalment plan.

PAYMENTS REQUIRED:
You are required to make each payment of the amount specified and by the time specified. Payment plans are not interchangeable.
By selecting to make payment on the NZSki Ltd Instalment option, the customer hereby agrees to NZSki Limited automatically charging the customer's credit card as supplied, with the % amount of the product purchased as specified on the payment dates listed below.
If your payment is unsuccessful, we will attempt to reprocess it the following business day.

Interest-free period:
Interest is not charged on this contract. Please see "what could happen if you fail to meet your commitments" below.
CREDIT FEES AND CHARGES:
Outside of a credit card surcharge, no additional credit fee is payable under this contract. Your credit contract may allow the creditor to vary this/these fee(s) and charge(s). Please see "what could happen if you fail to meet your commitments" below.
WHAT COULD HAPPEN IF YOU FAIL TO MEET YOUR COMMITMENTS:
Default of payment:
If any instalment payment is not made, e.g. due to the credit card payment being declined or reversed, NZSki reserves the right to charge a default administration fee of $35 per instance of a late or failed instalment payment.
Customers can update their credit card details online.
NZSki will not be responsible for the failure of the customer to make payment on the due date for any reason.
Statement of right to cancel:
The Credit Contracts and Consumer Finance Act 2003 gives you a right for a short time after the terms of this contract have been disclosed to you to cancel the contract.
How to cancel:
If you want to cancel this contract you must give written notice to the creditor, NZSki Ltd.
Time limits for cancellation:
If the disclosure documents are handed to you directly you must give notice that you intend to cancel within 3 working days after you receive the documents.
If the disclosure documents are sent to you by electronic means (for example, email) you must give notice that you intend to cancel within 5 working days after the electronic communication is sent.
If the documents are mailed to you, you must give notice within 7 working days after they were posted. Saturdays, Sundays, and national public holidays are not counted as working days.
What you may have to pay if you cancel:
If you cancel the contract the creditor can charge you
- the full price of the passes applicable at the time that payment is finally made or
- cancel the pass and hold any amounts paid as a cancellation fee.
This statement only contains a summary of your rights and obligations in connection with the right to cancel and refers to the cancellation of the pass and the recovery of reasonable expense by NZSki. If there is anything about your rights or obligations under the Credit Contracts and Consumer Finance Act 2003 that you do not understand, if there is a dispute about your rights, or if you think that the creditor is being unreasonable in any way, you should seek legal advice immediately.
The Credit Contracts and Consumer Finance Act 2003 gives you, as the debtor, a right to apply to the creditor (NZSki Ltd) for changes in the terms of your obligations to them in the event of unforeseen hardship.
CHANGES ON GROUNDS OF UNFORESEEN HARDSHIP:
Unforeseen hardship is where a debtor is unable reasonably, because of illness, injury, loss of employment, the end of a relationship, or other reasonable cause, to meet their obligations under their contract with the creditor. The debtor must reasonably expect to be able to meet their obligations if the terms of the contract are changed.
A request for a change in terms must be given in writing to the creditor specifying the reasonable cause that the payment cannot be made and outlining the requested change. The change might be extending the length of the contract and reducing the amount of each payment or postponing a payment (s) for a specified period. The requested change must be fair and reasonable to both the debtor and the creditor in all circumstances.
CANCELLATION AND REFUNDS:
All passes and products are considered non-refundable and non-transferable unless specified elsewhere in our terms and conditions. Please see our full terms and conditions.
Season Pass products will not be refundable (monetary or credit) under any circumstances unless Pass Protection has been purchased.
Pass Protection Cover:
Pass protection is your injury/medical cover and provides for a full or partial refund of the season pass where an injury, medical condition or pregnancy precludes season pass use throughout the entire season as per the sliding scale listed on our Terms and Conditions page.
Issue and collection of Season Passes:
Season Passes will not be issued or available for collection until full payment of all instalments has been received.
Disclosure:
The customer consents to NZSki making disclosures required by the Credit Contracts and Consumer Finance Act 2003 in an electronic form, by means of email.
